Center for the Arts Engagement Agreement

The Center for the Arts agrees to pay upon completion of the Artist’s performance on the day of said performance:

Payment will be issued to the Artist’s registered business name if applicable; otherwise, payment will be issued to the Artist’s legal personal name.

The performer listed above acknowledges that they are being contracted for a “Pre-Show” performance and are NOT to be considered an official opening act for the headlining artist, due to national/touring artist contractual obligations. Any promotional material created for said Pre-show should reflect this, nor should any official assets or materials from the headlining artist be used to promote said Pre-show, without express permission from the Center for the Arts.

Payment and Tax Documentation. Payment shall be made by company check to the Artist’s legal name as registered for tax purposes. If the Artist operates through a registered business entity (including an LLC, corporation, or registered DBA), payment shall be issued to the legal name of that entity. If no such entity exists, payment shall be issued to the Artist’s personal legal name.

An updated and fully completed IRS Form W-9 is required and must be submitted to The Center for the Arts prior to payment. The Center for the Arts shall not be obligated to issue payment until a valid W-9 has been received.

Force Majeure. The Artist and The Center for the Arts acknowledge and agree that neither party shall be liable for failure or delay in the performance of their respective obligations under this Agreement if such failure or delay is caused by events beyond their reasonable control, including but not limited to hazardous road conditions, severe weather, flooding, wind, or other acts of God. In such event, each party agrees to hold the other harmless from any claims arising from the inability to perform.
